Religious verdicts from Ash-Shaikh Ahmad Yahya An-Najmee
Excerpt taken from:
فتح الرب الودود
Q: What is the ruling of fasting the six days of Shawwal before making up missed days in Ramadan?
A: All praises are for Allâh. If it is possible to fast the six days of Shawwal and make up the missed days of Ramadan, meaning she joins between them beginning with the missed days if that is easy and if not then she may move the six (days of Shawwal) forward (fast them first) and delay the missed days as it’s time is vast and the time of the six is short.
Q: What is the ruling if someone fasting ate or drank out of forgetfulness?
A: If a fasting person ate or drank out of forgetfulness then he has not broken his fast from the hadeeth,
“Whoever ate or drank out of forgetfulness then he finishes his fast for verily Allah has fed him and gave him drink”.
Q: What is the ruling of the one whom eats or drinks thinking that fajr (daybreak) has not arrived and was then informed that it arrived or that the sun had not set and then was informed that it set?
A: If he ate or drank having doubt in the arrival of fajr and was not informed then his fast is correct and he does not have to make up anything, as for him being informed that he ate or drank after fajr being completely apparent with no doubt therein then he must make up that day. Likewise, if he broke his fast thinking that the sun had set and then was informed that it did not then he must make up the fast.
Q: What breaks a persons fast?
A: The one fasting breaks his/her fast by swallowing something from food or drink, intercourse even if sperm is not released in the act and what is like it such as masturbation with the hand, and making oneself vomit or swallowing it after it has reached the throat. Likewise there are issues which contain differing opinions such as using kuhl (eyeliner to darken the eyes for medical treatment or beautification) for example, sexual activity without releasing fluids, masturbation without releasing fluids, and what resembles these issues.
Q: What is the ruling for injections and swallowing pills for medical treatment?
A: As for swallowing pills then without a doubt it breaks the fast and there is no scholar that will say opposite to that, as for a needle injection then if it was in the vein then it also breaks the fast and if it was in muscle then this is debatable and the safeguard is not taking them except in a dire need.
Q: We have a muathin (caller to the prayer) whom the people rely upon to call the athan for Maghrib at the beginning of the sunset, is he to break his fast then call the athan or call the athan and then break his fast for the reliance of the people upon him for that?
A: All of that is permissible, if the sunset has become certain and he wanted to break his fast with a date and a sip of water then call the athan or wanted to call the athan and then break his fast then all of that is permissible and the last is more preferable to me.
